I think the real issue is that companies that host the content or scrapes for content and actively makes money from it is the exact problem. These companies need to compensate their artists ASAP, otherwise forfeit making money. And to go against your point, yes we should be allowed to use your artwork as inspiration or references, this applies to AI as well, but giving an exception to AI is not a good argument. AI is not making a perfect replica, they create something new based on existing artwork as we do as well.
