If i were to go to a PUBLIC book store where i can open any book i want and read through it
And then do so every single day for wvery book without ever buying one or paying a single dime
Then i'd be kicked out of the store
But suppose managment dosen't care...
Now imagine i'm sitting at this book store writting reviews about thoes books i never paid for
Regardless of i quote them verbatim or in an transformative way
Mearly the way by which openai and mwta and etc etc obtained the copyrighten works is illegal
Now assuming thoes companies do ask for permission/pay a small feed (be it the full ptice of an actual book ,possibly even an hardback copy from the second hand market or a discounted rate the publisher will agree on...)
Then when the thoes works'd be obtained legally there could be the argument regarding how transformative or not the ai is
