I would have a hard time calling a robot like 'Harry' a person unless I knew the technology prevented something like 'Order 66'. An instant re-write of the software isn't really possible with a person, and is possible with an AI. Unless that 'instant-evil-switch' or other instant change was prevented, I would have a difficult time considering a manufactured machine a person.
