Don’t forget that your lawyer has less motivation to wrap this up quickly than you. A great win can be a feather in his cap, so he may have motivation to see it through rather than settle out of court. Ask questions about how strong your case is, how likely you are to win, and how best to convince the seller attorney to strongly suggest a good settlement for you. I worked in a different kind of law (again, IANAL), but often times I found you can “make your case” way before you get to court so compiling your supporting evidence quickly and assertively can help a lot.
