If we are getting philosophical about the matter, posting nudes after a breakup is the same as showing off love letters or poems after a breakup in that the expectation of privacy is there when the gift is given. There is no rule or law that says such private and often deeply embarrassing communications be kept in confidence after a breakup. This is really little more than special pleading and pandering to a specific group that does not wish to feel the full force of their own actions post breakup. We can talk all day long about the expectations of a gift given during a relationship, but the fact of the matter is that once possession given over, it should be out of that parties hands. We create a moral hazard by doing otherwise. To put the final nail in the coffin in regards to intent of a gift, I would remind people that others have taken on great debts in relationships for their significant others that persist after a breakup, regardless of intent when given. This includes things like buying the ex a new car or paying for their college when the expectation was that it was an investment in the relationship. Why do these debts persist, but ownership of a photo must revert back to the giver? Special pleading is the reason, and nothing more. It should be stressed to trust the person you hand these photos to, rather than seeking to retroactively undo harm that the giver may have done to themselves by giving an ex a method to hurt them.
